Introduction

These Terms and Conditions apply to the entire contents' of the present website.

If you are registered user of Live In Care Work please note the legal entity you are entering into a contract with is:

The Talent Store Ltd trading under the name of Live In Care Work, a private limited company incorporated in England and Wales with registered company number 06032523 (VAT number 910188348) whose postal address is Crown House, 72 Hammersmith Rd, London and whose registered office is at 56 Masbro Rd, London W14 0LT, United Kingdom.

These terms and conditions are binding documents which govern your use of our services and our provision of the service to you. You are advised to read these terms and conditions carefully.

1. Definitions

The following words shall have the followings meaning in these Terms and Conditions:

"Agreement" shall mean these Terms and Conditions;

"Subscription" refers to a paid fixed rate giving unlimited access to our paid Services, as required, for a limited period that can be 4 or 30 days, purchased using a bank card or any other method of payment listed.

"Service(s)" refers to the entirety of the Services available to you via our site to Members, whether paid or unpaid;

"Paid Services" refers to all Services accessible, at rates quoted, by this site to Members with a valid subscription.

"Member(s)" refers to any or all valid registered users of our Service, whether they access Services or Paid Services.

"Member Content" refers to the information contained in the Member's profile, created by the Member and displayed on our site.

The terms 'us', 'we', 'our' refers to all brands owned and operated by The Talent Store Ltd for the purposes of this Agreement.

2. Registration/Subscribing

You must complete all of the fields on the registration form(s).

You should not have been convicted of any offence, or subject to any court order, relating to assault, violence, sexual misconduct or harassment. You are advised that a breach of this clause constitutes a serious breach of this Agreement;

Should you wish to register a friend or relative for our Services; you must have obtained the prior consent of this friend in order for us to process their data and provide the Service to them via yourself.

3. Use of the Services

Password(s) and any other information used to identify a Member are strictly private and confidential and must not be passed on or shared with any third parties.

We may deactivate accounts of Members who have not used the Services for 60 days or more.

4. Member Profiles

All member profiles are subject to our approval. We reserve the right to reject or delete any Member profile at any time if we believe it fails to conform to applicable laws and regulations. Further as a Member you are advised that not all content may be accurate and/or a person may not be who he or she claims to be. We cannot be liable for false or misleading statements by Members nor do we warrant their employment suitability.

As a Member you at all times remain solely responsible (and liable) for the use of your identification information by third parties or for the actions or statements made through your Member's account, whether these be fraudulent or not.

You agree that for content that is covered by intellectual property rights, e.g. your photograph you specifically give us the permission to publish this on the website, royalty free, for as long as you remain a member of the website.

You are responsible for the acts or omissions of any third parties who use your identification information or account, whether fraudulent or not. You agree to indemnify us against any claims of this kind. For the avoidance of all doubt; we shall not be liable if your identity is used by someone else.

If you feel or suspect that there has been a breach (of any kind) of your account and or the information displayed on your profile then you must immediately notify us. Furthermore; you should also amend your password.

5. Members Responsibilities

As a Member you agree not to use the website communication system or member profiles to promote or publish content that infringes the rights of others or that is defamatory, injurious, obscene, offensive, violent or can/does incite violence, or is any way shape or form racist or xenophobic; upload photographs or any other information in terms of data or files that are indecent. Further in connection with the provided services you undertake not to breach any applicable law, regulation or code of conduct;

You agree that you are solely responsible for the vacancy you are advertising and for ensuring the suitability of any candidates that you may decide to employ.

We recommend you verify work references, employment histories and undertake a DBS criminal records check. You also agree that age, gender, ethnic grouping and religion will not be used as deciding factor in any employment related decision.

When arranging to meet another person through use of the Services, you must take appropriate precautions, any such meetings are at your own risk and are not our responsibility.

Members should contact us regarding any inappropriate member conduct or usage of the website and we reserve the right to suspend or remove any profile for any reason we deem fit.

You agree not to use the Services for junk mail, spam and pyramid or similar or fraudulent schemes.

6. Service Access

We cannot guarantee the continual uninterrupted access to the website due to the use of third party suppliers and the possibility of system failure, maintenance or repair. Where maintenance or repair is required we will endeavour to give adequate warning and notify members in advance, whenever possible.

7. Payment Terms

Those members, who pay for a subscription, or other services, can do so by using a debit or credit card through the website.

The prices and terms of payment for the different paid services are displayed at all times on the website including at the point where a purchase is made.

No subscription is automatically renewed and it is your responsibility to renew your subscription to maintain access to paid services on the website.

8. Refund policy

This section applies to you only if you are a "consumer" as defined in the Consumer Protection (Distance Selling) Regulations 2000 and resident within the EU. You may cancel your order for the Services by giving us written notice within seven working days of placing your order. Within 30 days of your notice we will provide a refund. However, this right of cancellation does not apply once you have started to use the relevant Services.

9. Personal Privacy and data protection.

We take your privacy and web security very seriously and refer you to our privacy policy for further information.

10. Termination

A member may end their membership of the site at any time by visiting the Your Account page and following the instructions. However, you agree that you will not be entitled to a refund of any subscription or other fees already paid.

11. Exclusion of Liability

Except where expressly provided for in law The Talent Store Ltd shall not be liable to members or any 3rd party for the defect, failure, unsuitability of the website or its services. Also our liability of any kind relating to the services provided by us through the website, for any reason whatsoever, including breach of contract, breach of statutory duty or negligence shall be limited to £200.

12. Jurisdiction and Law

These terms and conditions shall be governed by English law and any disputes will be decided by English courts. If any provision of these terms and conditions is held to be invalid then the remaining provisions shall continue to be in effect.
